If the only way is to purchase a new copy of windows to get full updates that is the way to go. I would contact HP and see if they will ship you a set of Restore\Recovery XP CDs if possible.
I would stay away from Vista till at least the first service pack comes out (SP 1).
Between Vista and XP? I would go with XP Professional. The is especially true if you have less than 1GB of RAM.

Spyware cannot do anything except pass on details about which websites you have visited to a commercial tracking company. Viruses do not prevent you from downloading anti-virus software or anything else for that matter.
If you have a trojan then check which one it is by using Task Manager (press Ctrl + Alt + Delete) and do a Google search on each process to identify the rogue process that is running on your PC. Then do a Google search to find out how to remove it.
You do not need to reinstall Windows to get rid of a virus.

If you are not running a business, the Windows XP Home will do you just great. If you purchase a very small item, like a mouse from a computer store, they usually are able to sell you the Windows XP Home as an "OEM", and you will pay around $98.00 or less, if you reside in the United States.
Then you will have a valid lic., and Microsoft Windows Genuine Advantange tool will validate the key and you will be able to download SP 2, and all necessary programs, including all critical updates.
For your info. After you download all critical updates available for your pc, critical updates comes out every second Tuesday of every month, unless there is a real emergency flaw and Microsoft will issue a earlier patch.
Good idea to keep Microsoft auto updates checked on.

What I can assure you is that you pay only a one time fee for life that will include all auto updates, and all new versions for life. The Chinese don't believe in having to pay an annual fee for updates or new versions.
I can tell you their technology is light years ahead of any other known antivirus software out there.
If you open a webpage and there is a hidden virus it will clean in realtime. Anything that you download and has even a trace code, it will kill the download and ask you to upload the trace code for investigation. In real time the upload will tell you if it is clean or not.
