1) Since several religious denominations (United Church of Christ, Metropolitan Community Church, Unitarian Universalists) perform same sex marriages;

2) Since the First Amendment of the United States Constitution states "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof";

3) And since the 1996 Defense of Marriage Act respects the establishment of religions that do not perform same sex marriages while prohibiting legal recognitions for religions that do perform same sex marriages;

Isn't legal recognition of church marriages between consenting adults of the opposite sex while refusing legal recognition of church marriages between consenting adults of the same sex unconstitutional?

I believe that eventually, DOMA will be challenged in a court of law, and eventually be found to be unconstitutional, like many many previous laws against same-sex marriages and civil unions before that. People seem to think it is 'activist' judges who are creating these cases, when it is the LAW itself which is being considered. These cases seem to have been judged correctly, based on the laws in the states where same-sex unions have been allowed. That is the whole reason for the push behind trying to come up with a CONSTITUTIONAL amendment in the US. That is the only way to ban the same-sex unions, since there is nothing in the constitution that bans them currently

perfect now the legalization of gay marriage is something it fairly is desperate on a state by state foundation. There are some states wherein comparable-intercourse marriages are known and take place, while in others many kinds of comparable-intercourse unions may be banned. If there grow to be a push to nationally legalize comparable-intercourse marriage, the president would not have the means to do this on his very own. He would not have the authority to bypass a bill with in basic terms his vote - somebody in congress might might desire to signify a bill, and it might then might desire to be voted throughout the time of the domicile and the senate formerly it might desire to be written into regulation.

Gay marriages were almost allowed here in Australia, (well, in the Australian Capitol Territory at least). Then the Prime Minister decided to disallow it.

Pain in the butt, but we had a commitment ceremony with all our loved ones anyway. Exchanged rings, did everything, else, just no Marriage "license".

To us we are married. To our friends we are married. No-one else matters.....

Absolutley Gay Marriage in the United States.
It's a free world, always have and always will be.

Remember, God did created homos, and not only he created straights for marriages, but also created gay marriages too.

Look at Sir Elton John and his partner, they wed didn't they???

Life would be boring if there was no gays.

I suspect that we are about 10 years away from legal gay marriages....just have to kick the fundamentalists out of office.

Even the US Supreme court is slowly moving this way....

well, if u want to marry a person of the same sex, ur not gonna go to a christian pastor or someone u know is against it. unless u know theyll do it, why bother? get married by someone who will accept and announce it. y go thru the trouble of having to actually convince someone to announce ur marriage with the person u love. u know? o and yes i think that IS unconstitutional. =]

Nope!

Any "legal" marriage first needs to have the Marriage License to make it a legality.
