A DUI generally counts as a traffic violation, unless you run over someone, cause extensive property damage, etc. Most states have a set fine that accompanies this type of violation. People generally don't go to jail for DUI (except for sitting in jail until the drunkenness wears off) unless it is their third or fourth offense.
