Before anyone again answers out of hand that he has no chance, I suggest you read for example DeLong v. DeLong, Case No. 80637 (Sup. Ct. Mo. 1998).
Without knowing the state in which the action is occuring and the specific circumstances of the case, NO ONE can give a valid answer

Get a lawyer. Can he prove this? Is there evidence? Are you denying it? Is it a bad thing, really? Why is that a negative? You're still a good mom right? Maybe don't be with anyone until you're officially divorced so he can't get you on being unfaithful. I most important thing that the courts look for is whatever is in the kids best interest, and I'd think that taking the kids away from you would not be in the kids best interest (assuming you're not abusing them), they could afterall develope separation anxiety disorder. Dr. Phil just did a show about how divorce affects the kids and listed the top and worst mistakes divorced parents make to screw up their kids. Check it out and don't do the things listed and I would gather that it would help you in court.

Well I don't know. Is the reason you are getting a divorce because you decided you wanted to be with women and needed to get out of your marriage? If so I hope he gets the kids. That is a f ucked up thing to do to someone. "Oh no I am gay and the person that I married isn't doing it for me. I need a divorce!" Why is it that gays get a free pass to get a free pass. They can get married to someone, make the person love them, have kids and then when they decide that the time is right they divorce. They have ruined some poor man or woman's life because it is their "life style choice" F uck that. But don't worry, I am sure some liberal judge will give you the kids no matter what is good for them.
Oh ya if I am wrong and he caused the divorce and he knew you liked women before you two got married, then good luck. Kids need to be with their mother...If she is a good person. Gay or not.

Not true. It is not against any law, of which I am familiar, to be gay. However, during this time I'd suggest you not give him ammunition to use to drag the divorce out and cost thousands in legal fees. If you feel you are a good mom, keep your head down for awhile (which you should do anyway during this upheaval), be fair, prompt, caring and wait until it is all over before acting on anything-- male, female or aliens. Give the kids a chance to find their balance before adding someone new into the mix.

I've never heard that. He would have to be able to prove that you are unfit to take of your children or prove that you've cheated (in some states) to get custody of your kids. Speak with an attorney concerning your rights. That way you'll know what your going into and what is admissible and inadmissible in a divorce proceeding. Good luck.

I'm dying to enlighten you..please read: http://www.sciencedaily.com/releases/2003/06/030613075252.htm..especially the paragraph that starts, "In contrast". Acting on your attraction is different that the normal attraction women get in fantasies.
Also, I doubt in this day and age that a judge would take your children away for your sexual preferences. Check with a lawyer to be sure. I really hope the article helps you!

I'm not sure about that at all . I don't think that's normal for the same sex to attract but to each there own . Maybe you should think how it would effect the kids for them to have 2 Mommy's and what they would have to go through in life living with you verses the dad. All I'm saying is think about the kids feeling first .

All you need is a good lawyer. He cannot get custody based on your sexuality or else that is considered discrimination! Don't let him lie to you like that!

He probably can't and is just trying to control and hurt you. The fact is in most all states in the U.S. the mother will always get custody outside of drug abuse.
