Providing our military didn't somehow "misfire" or torture him to death - he would be found guilty of crimes towards humanity as well as murder and probably hundreds of other charges. My question here is what would the Al Queda higher-ups do if he was caught? Would they threaten to behead a bunch of American soldiers that America says that they're "expendable" and would not "bargain" with to save their lives? Who knows - but one thing for sure is that America needs to rebel and tell every politician that, "I am mad as hell and I am not going to take it anymore!"

He would be brought to an International Criminal court not a US court. Just think during Voire Dire for the Jurors in the USA Osama's Attorneys would have a field day with it. He hasn't consipred to kill just Americans Say what you want about the criminal court in the Hague, but it is for reasons like this they exist

It has been kept quiet, but a jury has the right to acquit a defendant even if he has broken the law. Basically, they can put the law on trial. This is in effect in America and Britian, but I'm not sure where else.

i believe that osama bin laden was tried and convicted in absentia by the clinton administration in normal courts.
if you let gonzales try him he will be found innocent by virtue of GOP incompetence.

Probably, here in the US. He'd get off due to something stupid like- He wasn't read his rights. And then they would let him go and he could collect SSI because nobody would hire the creep.
