Also, I don't believe there is a 2nd Degree charge for a murder attempt.

Attempted Murder carries the same consequences as murder in its degree. In this case, the penalty for second degree murder in most states is defined as a murder that is 25 to life imprisonment with a chance of parole. Attempted Murder is a very serious offense, so it is dealt with seriously.

No such thing a 2nd degree attempted murder.
Some circumstance may lead to 2nd degree murder---and some may lead to 3rd degree murder. And if you had a plan to murder, that would be first degree murder.
But if you ATTEMPT an act, that implies forethought. A deliberate act. Likely this would be assault to inflict bodliy harm...
