How do i homestead in ellis county...... And do i have to homestead as a married person if my house is only in my name and i have a post nump..... It is my house only and my primary residence.... my husband lives in indiana......

But since i have a post numputal agreement doesnt that mean that the house is only mine????

Apply for your homested exemption at the Tax Assessor's office in Waxahachie. It's at 114 South Rogers St.

TX is a community property state. Since your husband doesn't live in TX you'll have to check with a local attorney to see if you can do this on your own. If your husband lived in TX it would be very difficult unless you owned the property prior to the marriage or acquired it by inheritance.

One of the homestead laws in Texas is that a spouse has a right to occupy the home- so when you sell he will need to sign giving up that right- even if he owns none of it.

If you get divorced a year from now and sell this 10 years from now, you may still have to track him down to sign those papers at closing.

It is very difficult to own separate real property in Texas. If you pay home insurance or property taxes with community money (money you earned while married) then the house may become community property.

Make comparisons with a lender - what do you qualify for by applying with just your income & then what is available with both people on the application.

Texas is a community property state, I don't think it matters whether spouse is on the deed or not. He would still be entitled to claim in Texas.

Definitely find a real estate attorney and a good realtor. Get all your ducks in a row financially so you know what you qualify for and how the closing will go. Don't get surprised at closing because your lender wants your "husbands" signature. It's a Texas thing...
