I live in GA have a web url southernnutrition.com - I want to design and open my web store and forum soon. I am worried that southernnutrition.com may infringe on a store in FL, named Southern Nutrition, that does not use the url SouthernNutrition.

You indicate that you registered the www.southernnutrition.com domain in your name through some registrar. This means that you own the domain name. As long as you continue to pay the registration fees when they come due you own the domain and may use it.

I checked the records and see that this domain was registered initially on 20 October 2005 for 2 years. I presume this is you but will not provide the name herein.

If there is another store somewhere called Southern Nutrition that may have been in business before you wishes at a future date to establish the domain www.southernutrition.com for himself he wil find out that the name is taken. He cannot take the name from you.

He can ask you if you would be willing to sell it to him. You could do so if you wish at whatever price you and he agree on. You could also decline to sell the domain.

He could then try another extension and register www.southernnutrition.org or www.southernnutrition.biz for example provided such was available to him. If you wish to block him from using these names, you can register them to yourself as well.

That would depend on which organization was incorp. first. If they came around first then yes you have a conflict and you should fix it before money becomes an issue. If you were the first with the name then they may have a financial issue in regards to your url.

You can use the url cause you own it but you will probably have to actually give the store another name.
