Then when you call them back to tell them that "no, Jessica does not live here, nor do I know her" get told that they can press charges against you for fraud??
Is that even legal??

Tell them to do it then you will sue them for filing false charges and you are logging the date and time every time they call and if they keep calling you're going to take them to court for harrasment.That should get them to stop calling.

yeah, i've had messages for other people, most of the time they think that just because you have the same last name or live close by that you'll know the person. and no, they can't press charges for fraud because it's NOT your responsibility to inform a total stranger the whereabouts of someone else unless the LAW is looking for them, and even then (like with bounty hunters) you'll be charged with obstruction of justice, but that's when a crime has been committed.

I usually tell them there is no such person at this residence and if they give me crap I say even if I knew the person, I'm not no freaken secretary. whatever personal business they have with that person is between them, not me.

Ignore them. Jessica is the only one who can be charged with fraud, and only if she's the one lying about her identity. Since you're telling the truth, and you're not trying to evade any legal responsibilities, you have nothing to worry about.

If they keep calling, call the phone company and tell them the bill collector is harassing you.

No they cannot and they will say almost anything to get you scared enough to pay the bill... You have a right not to pay and allow it to go on your credit...You wont be happy that way and it is better to work it out but whatever!!

It depends upon your state. You can prove your identity by offering the beligerent bill collector to come and do a "house check" of sorts and prove your identity in person by providing a photo id, social security card, etc. And even provide your credit report stating that you have had no prior business with this company. And have a witness present. If that route is not possible, contact your lawyer immediately and see what they say.

Those people are so full of it. All they do is try to scare people into paying their debts. What they do is against the law. If that continues to happen tell them that you will press charges against them for harrasment and false accusations for a bill thats not yours. So yeah.... I never answer my house phone anymore...freakin telemarketers!!!

I had collectors calling here for my ex husband's girlfriend. I guess somehow they do a skip trace and my number go thrown in even though she's never lived here before.

I told them that I didn't know her and I had no way to get a message to her because she lives with my ex husband and there's a court order that he and I can't be in contact. They accused me of lying and told me that I was her. I had to get a lawyer to get them to stop calling me.

I would double dog dare them to press charges. The investigation would vindicate you. I don't think that its legal. Look up the Fair Credit Reporting Act.

They are not harrassing you, they believe your phone # is that of someone they are doing business with, if they have a wrong # & you tell them its wrong, they will think you are lying to them. Most of the people who say wrong# to them ARE LYING. So just say,"ok Jessica is in the bathroom, hold on I'll get her", then just put the phone down and go away. If he calls again, say you waste my time, l'll waste yours, hold on I'll get Jessica.

If she really doesnt live there they cant do anything. If she does and you're lying they may possibly be able to press charges because you're giving them false information. I dont think they can do that though, but they can press charges if you pretend to be her.
