I'm wanting to participate in some air gun battles with my friends but I was wondering if I could get in trouble having one on me or in my car? I am on probation and my po says it's not a violation for me to have a non deadly weapon but if for some reason I were to get in any trouble for having it and go to jail that could be a violation. I am in TN not sure if that matters.

Well first of all it depends on how you present the weapon if you were to point it at someone or to walk in to a store and threaten some one then yes this would be against the law for the simple fact that you are trying to pull this weapon off on some one to make them believe that it is a deadly weapon. If you are using this for the simple game of air pistol battles then no it would not be against the law as long as the setting of the game is not in a public place to where other civilians could mistake these toys for real weapons that in fact would cause the police to investigate what was going on and could possibly land you with an intent charge to do bodily harm if you were to hit a civilian.

Yes you can be arrested, since you are in probation you are not allow to carry any kind of weapons (air pistols are in the same category of knives, some states require background check).

And contrary to what some people believe, air pistols are deadly weapons (that's why they are not sold to minors and why they are packed with tons of legal and safety warnings), there are police records of confirmed deaths and mutilations due to improper use of air pistols; it's even a felony to aim one of those agaisnt anyone.

Felons are not allow to buy, use or carry anything with the shape and look of a real gun. Any one can argue that you want to do a robbery with that air pistol; so your p.o. would send you to jail very fast..

Think about it. You're on probation. Do you really want to leave a decision about whether carrying an air gun is OK up to a cop who might be having a bad day and has happened to stop you for a tail light being out?

Smart money says, "Don't carry it around at all. Get over your probation, then do what you want."

I would use extreme caution on this... I don't know if you will be arrested, but you could get shot. Think about it, your on probation. The air gun can be mistaken for a real weapon. If you are allowed to have it, keep it in a case in the trunk when in the car.

Asuume you're in the US? Don't know about US law, but if you're on probation its probably best not to carry one. That way U casn't get into trouble. R U going to somewhere fairly deserted for your battles? Maybe a friend could carry one for you till you get there. Hope this helps.

You can get arrested for anything anymore. Make sure not to look at someone the wrong way or you might spend the night in jail.

Call the police department and ask--better to get the right answer rather than an opinion. Good luck.
