As misguided and hateful as it was, it still falls under the 1st Amendment.
It is very, very dangerous to give government any power over speech; it is especially dangerous to give government power to declare speech criminal.

Well as stupid as it sounds, they were targeting one
individual that they had been arguing with so I can see
how they would be charged with a hate crime.
If HR1592 passes it will be a hate crime to say " I don't
like the homosexual lifestyle" to me that is a violation
of the 1st Amendment , why can't I express an opinion?
Why isn't the 22 year old African American man being charged with a hate crime for beating a 91 year old white
man and why aren't Jessie Jackson and Al Sharpton in
an uproar over that?
EDIT: betterco, This is true, the guy was not yelling
racial slurs, so your are right. No hate crime there

It may be a hate crime. If the flier targeted an individual (it did) and was a call to do physical harm to that individual because the person was gay, then it is a hate crime. But we don't know the content of the flier other than it contained hateful words. It all depends on what was in that flier.

Yeah, it's a hate crime and the punishment fits.
Where as I am a stern believer that homosexuality is one of the biggest threats to contemporary American society, I do not believe in intimidation or racketeering style tactics especially by 16 year old girls on a person who chooses to live their life the way they want to live it.
Justgetit I agree with you about the HR legislation, that is going wayyy too far but the reason why the black guy wasn't charged with a hate crime is simply because he was not yelling racial epithets at the old man while he was beating him, it clearly was simply a car-jacking.

No, it's not a hate crime. Seems that freedom of speech only applies to minorities and those who wanna bash anyone with any kind of moral values. If you oppose the views of some minorities (gays, illegal immigrants, etc.) you are immediately labeled a racist or intolerant, while those groups can say and get away with anything they want. By the way, isn't every crime a hate crime in some way?

Where does free speech end and hates crimes start. I believe that homosexually is about chemistry not about choose, but, pictures and bad words do not mean a crime has taken place
