Do patent research. In many cases you can you can patent the method by which your item is constructed, but not the idea itself. Google the word patent and your state to see if your University offers help. It costs many thousands of dollars, so you would need to apply for a loan.

Don't sell your item during the patent process.

In the end, you may just have to launch it, wait for it to be copied and be ready with your next great invenrion. That's what I did. I sell it from a website and in 5 years, nobody has copied it.

Go to http://www.uspto.gov/ to see if your idea is patentable. Follow the instructions and you will see if anyone has patented this or similar ideas.

Next, go to http://www.score.org/ to find the nearest SCORE chapter. In the upper left hand corner is a box to enter your zip code. Your nearest SCORE chapter will be on the next screen. Contact them to arrange for a free one on one meeting with a SCORE counselor about filing a patent application.

SCORE is a nonprofit organization. They provide a public service by offering small business advice and training.

SCORE's 10,500 volunteers have more than 600 business skills. Volunteers share their wisdom and lessons learned in business. The volunteers are working/retired business owners, executives and corporate leaders.
