I live in the province of Quebec, in Canada.

My boyfriend bought a house recently and there was a person renting the little bachelor attached to it.

The thing is: my boyfriend bought a 2 bedrooms house. Not a duplex with a tenant.

My boyfriend told the ex-owner he wanted the tenant out when he'd take possession because his dad would be moving in.

When he got the house, the old man was still there so my boyfriend went to him and told him he had to be out by the end of the month because his dad was moving in.

His dad has to move in by June 1st because he'll be in the street by that day.

The tenant has NO lease and we've been telling him he had to be out by June 1st for the last few weeks.

He says the ex-owner didn't tell him and that he couldn't find anywhere else to stay. We think he's not looking.

What's the legal way? He has no lease, the house is considered a one-family house and the room has to go to the new owner's father.

You may have to go to the Rental Board. If he has no written lease he has a verbal lease. With a verbal lease you have to give him one month`s notice. At this time of year is very busy at the Rental Board, so if you decide to go this route you must tell them it is urgent. Good Luck!

You need to go about this legally. Contact a lawyer and see what your options are. You may have to go thru a couple of legal hoops to get the guy out. It should not be hard to evict the guy unless he can produce a lease of some sort that indicates that he has time left to live there.

I would not advise that you accept any money from the guy because that might be construed as a rental agreement.

I have heard of situations like this before where people buy a foreclosed home and go and find a family still living there. This is not a unique situation and a lawyer should be able to help you figure out what to do.

legally if this was the terms in the contract of buying the house then the owner who sold it to him breached the terms of the agreement by not fufilling his obligation of legally evicting this tenant. i would speak to your lawyer who handled the closing and they can reneg on their deal or seek monetary damages bc now they will have to pay moneys to have him evicted. speak to your lawyer and they can advise u from there.
