It depends on the rules and regulations set out by the school system the teacher/partner are working in and varies from school to school. You do not indicate whether the domestic partner is a paid aid or a volunteer one, as that would have a bearing in most cases.

Schools usually do not turn down volunteer assistance unless the person that voluneers has a criminal record in most cases.

In some States, this creates a conflict of interest, but I don't think it's illegal.

There is no law prohibiting that situation. The school, however, may have a policy that prevents it.
