After five years, would like to file a lawsuit against former employer?

Working here in Saipan, gone to philippines for vacation, employer hold on to my work permit, said he will send it to somebody else , so i wait , call him from philippines just promises, never send my work permit, until it expired. now i'm in philippines, jobless, more than five years now.

File a complaint in court against your superior for holding on to your permit until it expired. The complaint must also include your expected salaries plus damages arising from this irregularity.
