i know a guy who just turned 16 and he is being messed with by his dad... if he was to kill him would he be excused for murder?

Probably not! If he's 16 the jury and courts would feel that he could have found another option besides murder. He'd probably end up in prison.

Even if he could get away with it, killing someone is never the answer, and why should he have to spend his whole life living with the guilt and trauma from killing his dad?

Have him contact the police or a social service agency to get help in getting his father away from him. You could even call for him if he doesn't want to do it.

No. It would not be self defense as he doesn't have to kill his father to end the abuse. All he has to do to end the abuse is to report the father and the police will take the father out of the home.

If the boy was looking for justice, he will get it from the courts when the father is punished, and everyone can depend on justice from God. Jesus said, "God will not be mocked. What you sow, so also will you reap.".

In another place, Jesus said, "If anyone places a stumbling block in the path of one of my little ones(children), it would be better for that man if a millstone were tied around his neck and he was thrown into the farthest part of the sea.".

Murder is murder in any case hun..it would be a lot better if you just tell on it instead...it would make things easier for you and your life as well as your younger brother....I know its hard because hes your dad and you don't want to get him in trouble or take him away from your mom but its hurting you and your brothers future...you know what you need to do don't kill anyone..it will only make your life worse...prison isn't the right place for you it is for your dad

"Messed with"?
Even if He dad was kicking his a** it would still be considered assault, not attempted murder.

"Self defense" claims (depending on the state of course) are usually allowed only when You honestly feel You have NO CHOICE but to "kill or be killed". Does He REALLY think his Dad is going to honestly KILL HIM?

If His Dad is assaulting Him He should look to other options like reporting him to CPS, going to a shelter, even finding a lawyer & suing him...

NO. murder is defined as: The unlawful killing of one human by another, especially with premeditated malice.

So no matter if his dad is tripping balls all the time, it gives him no excuse to kill him. Now if the father is molesting him, the child has the right to seek help. But still if in that case, he would still be guilty of murder, unless a hospital sought the boy as a 5150, in other words legally insane.

HE (your friend) is an innocent victim now, once he takes a life.....unfortunately the loser father becomes the victim....Call the police, this is no laughing, joking matter. Be a good friend and help him out, he must trust you enough to have told you what is going on....He needs you to point him in the right direction. Not the road to regret later on.

If he is defending himself against an attack that could seriously injure or kill him, then it is not murder. If he is being "messed with" by his father and then sneaks in and kills him while he is sleeping, then he will be charged with murder.

No, but depending on what the messing with entails, he might get a lesser charge. And if he has to use deadly force to defend himself against a physical attack, that would get him off.

First of all, you are his friend or aquatense. Please tell someone
in a n authority position. I'm sure the person you tell will not tell on you. Don't keep quiet about this. Don't let this come to murder or some kind of mishap.
