Ok, here's the synopsis:

Jane and John are married. Jane sleeps with another man and ends up pregnant. Jane and John decide to put the mistake behind them and stay together. When the baby's born, Jane and John both know the child is most likely _not_ John's, but they list John's name on the Birth Certificate anyway.

Several years later, Jane and John are divorced and a paternity case is filed and the results show John is not the biological father. The biological father is ordered to provide healthcare and pay child support for the child.

My question is this: Is the Birth Certificate updated at this point to reflect the child's correct biological father?

Yes, the correct Father's name will go on it to reflect who he is. Not only for the child but for the state to collect child support from him.

It should be. John's attorney should follow through and make sure that his name is removed from the birth certificate. If John truly wants to be severed of all connections, then this would be the final way. That way, the bio-dad can take his rightful place, or if this child is to be adopted, then the adopto-dad can put his name there.

The only way the birth certificate can be updated is if the biological father signs the new birth certificate. May take some legal work but thats how the birth certificate gets updated in the state i'm in.

Dont understand how the biological father is paying child support and health care, with out being on the certificate now.
unless he agreed to it.

If the court has ordered this to be. However, is the ex still in the childs life. If the ex has always acted as the childs natural father and still loves the child and wants to be in the child's life then he indeed should remain on the child's birth certificate. Only if he still wants to be a part of the child's life.

The birth certificate is only amended if the court orders it. But it sounds like hubby’s paternity was disestablished and bio-dad’s paternity was established. Therefore, the court should have ordered the birth certificate be amended. Did they not?

It should be but it isn't automatic. My husband's ex girlfriend has his child and the child has HER name even after the paternity testing and everything. I would like to know what to do about this too.
