Sometimes, if the Court feels that a debtor acted in bad faith or for some other reason, the Court may bar the debtor from re-filing for some period of time. Or, once a Motion for Relief is filed by a creditor, if the debtor voluntarily dismisses his or her own case, then that debtor is automatically barred from filing a new case for 180 days.

Yes you can. My husband and I were going through a Chapter 13, in which they take payments directly out of your paychecks. My husband was laid off from his job after 9/11 and we were unable to make his half of the payments, so it was dismissed. You can file again as soon as you are able to make the payments, but they have changed the laws. You have to go through 6 months of financial counseling before you can actually file, BUT the credit companies get a notice and they legally cannot call you at home, work or cell phone during that time.
