Hi! My little brother is 14 and has lived with his mother since he was a baby (when our dad and his mom separated). He has expressed multiple times that he would like to move in with our father and I, but his mother is against it. My father has considered going to court, but we're unsure of the laws in our state and whether or not he will need a lawyer. I just need to know if 1) my brother is legally old enough to make the decision and 2) if not, will a lawyer be needed.

Is there anywhere I can turn for for sure answers for my states regulations on this?

A lawyer is almost certainly advisable reguardless of where you live. Check with legal aid at your county courthouse. If nothing else they will be able to guide you to a lawyer who can help. Also consult the minister/pastor/priest/whatever at your place of worship. Clergy usually have to help people with legal problems and might know where to turn for help.

His mother has a lot of say in the matter and judges usually side with the moms as far as custody goes. Unless your brother lives in a dangerous situation (abused by people in the house) or you can prove the mother is unfit, you really don't have much of a chance.

When your brother turns 18 he can move out. He might be able to do it sooner but that requires emancipation and that is rarely granted.

not sure of the state you are in but in texas the consultation with a atty is often at no charge
