The best way to do this would be to contact paypal and have them help you and the seller put a hold on the money they're going to send to you. The way this works is they 'send' the money to you but you can't touch it until they get the item back and they releace the money. There is also no way for them to keep both as you also have half control over the money, both people have to ok it either way.
I forget what steps must be taken to do this as I did that over a year ago so you'll have to contact paypal and talk to them but they were really good about setting it up.

Pay pal's job is only transfering money to somebody as per request.They cannot be held liable.You can file a police complaint ,if you have documentary evidence.A civil case for cheating is possible,for which full postal adderess of the seller should be available.It will take time to get it back.Ebay purchase is always risky unless you buy branded goods from reputed sellers.

Give the seller 30 days ample time for full refund, if you don't receive a full refund after your notice, Give the seller a notice that you will take legal action. Write to your Consumer Protection Agency or hire an attorney as soon as possible!

Only if it breaks the rules on trading or a crime has been committed you can pursue the matter through the civil courts but if you tell them you are going to the police it might shake them other wise right it off put it down as experience and be careful in future Dave

E bay never got my money back, even though it was reported to them, one thing I've found out about e.bay is they have no teeth, just hot air. You could try claiming it back off your credit card, maybe you'll have better luck than me, as my credit card company just pushed me from pillar to post, and still didn't get any where. As for the police,"no" but you could try a solicitor, although this is going to cost, so i guess you must make the choice as to whether to pursue it or just let it go, but make sure you leave a bad feed back on this persons e bay account.

No I'm affarid the police will not get involved as this is a Civil matter to be dealt with by a Solicitor.

put it down to experience
my stepson bought games from america and they never arrived,but the seller took the money
he never got the games after 3 months of emails

The UK police do not take fraud seriously.
I reported a one million pound tax fraud but they would not even listen let alone look at the evidence. You have not got a chance.
