My mother's will split her money three ways between myself and two older brothers - the older one lives abroad and it has come to light that he still owes maintenance for his children in this country - if I paid it and sent him the balance - could I get into trouble?!
How would the court view it if he decided to be pigheaded and sue me for it?!

I have the money from a house sale - he had already signed the house over to my other brother!
What would people do if they were me in view ofthe answers I have had so far?!
Would you risk it?!
It is only a very small percentage - my brother is so greedy and mercenary and the he owes my ex sister-in-law about £1400 from 20 years ago! He moved abroad and escaped paying it!

If you are the executor of the will, then you have a fiduciary duty to do exactly what the will stipulates and safeguard the funds until they're disbursed. If you make your own decisions about what you feel is right, you can be sued and may be accused of a criminal act.

If there was no will, the situation gets more complicated.... but if you do something that your brother can prove was not what your mom had in mind, he might sue you personnaly and prevail. Even if he doesn't win, you could end up spending a lot of your own cash on legal bills to defend yourself.

Money legally inherited by you through your mother's will is your money. You report that your mother's will equally divided her "money" among three children. You only have access to your share of the money, not your brother's, so how do you propose to pay anything out of his share and send him the balance?
