You need to call any criminal law attorney and ask what your rights are.
Age of consent in USA is 18. This man committed statutory rape in most states. Doesn't matter if it's 16 in VT. I suggest you pursue this ~BECAUSE~ with this perv being 31, chances are, there's a history of this kind of behavior with him. He may be wanted somewhere for something similar. In the event this is his first offense, he will be held accountable. Make sure you're ready to go the distance to have this wack job put out of business.
Also file a complaint with the local police immediately. The sooner it's down on paper, the better your chances are of ending this guy's sexual predator action.
Keep in mind all the perverts they catch, trying to entice teens online. You don't know what Else this guy has done.Don't assume you can do nothing. TRY!

The 31 yr old is not in the right - but if your daughter had sex willingly with him - then your daughter is equally to blame in this you know -
So is it your position he should go to jail and she should not ?
Is it your position they should both go to jail ?
I am not saying what happened here is right - but how is it a criminal matter - was it rape ? From the sound of the question it was not -
Maybe talking to your daughter is an idea instead of criminally prosecuting this man ?
What will it get you to prosecute ? A daughter that hates her mother ? Never tells you a thing again ever ?
How are you defending your daughter after the fact for a willing decision mades by her ?
What cause are you fighting - You can not undo your daughter past actions you can go back in time - What will you acomplish assuming you could make a case ?

I am sad to prove this fact to you. However, if your daughter is living under your roof, the only thing you can do as a mother is discipline her. She may rebel and fight your beliefs. But, being a mom too, this would be a hugh issue for me and I would do something, find something that would help her realize that this is not appropriate behavior. With all the risks related to sex crimes,etc.
But, that is the answer that you asked and was told it was 16 and the person who told you this was correct.
Just be sure to keep that guy away from your family. I wouldn't want the stress either.

No. It's wrong. Legal age of consent is not 16. Probably 18. And the age difference makes the act rape. The guy can go to jail for it.

IF you check the statutes in Vermont, you will see that 16 is considered the "age of consent"....
That being said, if this little hoochie is living in your home, you need to ground her and pay more attention who she is hanging out with.
As for the guy, I remember once when an "older suiter" was trying to date me...My mother was totally against it, of course. She told him to stay away from me or suffer the consequences. The next time he showed up at our door, she met him with a .22 rifle and said the next time he showed up she was going to blow his head off.
That put an end to that. He never came around me again. You see, my mother was serious, and he knew it....and she would have done it.
Of course, I was raised in southern Oregon in the 40's and 50's where a parent could actually protect a child if needed.
