Everyone has the right to sue everyone for anything. Whether you win or not is another story. I assume you intend to sue for some sort of intentional tort...whether it be intentional infliction of emotional distress or physical battery (of the smoke). Good luck!...I think you'll need it.

If you can prove that you have been harmed by his smoking, then you have a right to compensation. But it would have to be a class action law suite with the majority of the employees in the office who are affected by his smoking. Just one individual may not be enough to sway the court, but defiantly if there was a class action.

You also have to show the court that you tried to get him to stop. You have a right to ask him to stop. You can address the owner of the office building, and they can force him to stop.

You have to try to make rectifications before you start suing people.
But you probably have a case.

You have the right to complain to the general manager, who is able to punish him according to the internal regulations. You can sue in court the company for that, not him. What he is doing is breaking the regulations. The company is the one breaking the law because is not requiring the enforcement of the law there.
You could also sue him for attept of murder by nicotine intoxication, but I have a feeling you would lose ;)

You can sue anyone but we need to know more about the size, type of organization and whether or not the business falls under the rules of the Clean Indoor Act of 1975.

You can always quit.

Sounds like a boss who does not care about his workers. As to smoking in the building, there are two things you need to find out first. Number one, The legality of smoking in the building in your local area, That is City, State, and County ordanances. Number Two, The company policy on smoking in general, if he is in violation of the company policy, inform him of the policy. Then follow the rest of the policy as described. If no company policy, inform the person who is in charge of your boss, his boss.

You should take it one step at a time. First ask him to stop, if he doesn't file a complaint with Human Resources. If you don't have an HR department and he refuses to then maybe you should speak to an attorney. Hope this helps.

Sure, go ahead. Find an attorney and be prepared to pay a retainer of $ 1000.00 or more, and if you lose, be prpared to pay your company's legal fees as well,and say bye-bye to your job.
