No, whilever he is legally married, your relationship would not be considered to be common-law. There was a question on here about a woman who was married to a man for a couple of years, then gets a phone call from his other wife telling her to stay away from her husband. Although she had the wedding certificate, the other wife had a wedding certificate too. The first wife's wedding certificate was the only legal one...the other wife had no legal leg to stand on.
He needs to get a divorce from his wife before you will ber classed as his common-law wife.

What if he was legally married to someone never got divorce. Common law married to another which is written in the court as common law been together 18 years with 3 children, we have assets together and his legal wife dies ... so does that mean we count as common law now?

He has to get divorced, and should have 2 years ago, before anything you and he does is in any way legal. You are considered his mistress and you are having an affair with a married man - wow, what a catch of a guy.

no you are just shacked up not married and as long as he is legally married to his wife then she is his only wife! it doesnt matter how long goes by.he first has to be legally divorced from her and after that is final live with you at least an additional 7 years.not all states do this anymore and common law marriage is not recognized everywhere either.good luck.if this man loves you he needs to divorce her if he wont be rid of him he is just using you as a rebound.

Nope and common law went out years ago in most states where do you live? And if someone is married they can't marry again and why would you pay for his losing butt let him get his own insurance!

No his first marriage takes precedence over all the rest. Until he gets divorced from his first wife you two can never legally be married so you better get him divorced immediately and legally.

First, common law marriage is not recognized in all states. Only handful of states recognize them.
Second, both you and your boyfriend know that he is not divorced. Common law marriage is only recognized if you and your boyfriend intended to act as married - his incomplete divorce nullifies that intent.
