Defense against the property can be exercised validly by shooting an intruder at night. It is a valid exempting circumstance for the injury or death sustained by the person intruding under the Penal Law.

I am unsure about Texas, but unless your life is in jeopardy, you CANNOT shoot somebody. Regardless if they are stealing your stuff. I know that it sucks. But to go to prison for manslaughter for a lawnmower or some replaceable item, you only shortchange your family. They need you more than whatever item they stole. Think with your head and not your heart. Now, on the flip side, if they are in your house, and you feel that they are a threat to the safety of yourself or your family, do what you have to do. Just remember, if you shot and miss inside of a house, the bullet or shell will still travel, so aim true or risk hitting a loved one! Read article below.

if anyone threatens your safety in or out of your home you have the right to use deadly force. he does not have to actually be inside. i am a retired officer in texas

No...you can never kill to protect property...he must be putting you in a fear of harm for yourself or your family...you can never shoot a robber in the back...but you can use reasonable force to go and get your property from him.
