If a woman knowingly commits this kind of fraud, why shouldn't she be subject to criminal and civil penalty?

Let me explain, currently in most states, if a married woman has a child that is not her husband's and she doesn't disclose this to him and he unknowingly takes care of the child and it is later revealed that he is not the biological father, he is still liable for the child support. Also, if this is found out, later the woman faces no criminal or civil penalties.

I was married but seperated from my husband and I told them my husband was not the father and they still listed him as the father. We had to go through a paternity test to prevent him from paying the support and to remove his name from the birth certificate. I live in Ohio and they told me it did not matter to them that they HAD to put my husbands name there.

That is pretty messed up--the problem is that there's a child in the equation, and that's what I think is the big obstacle from removing that liability.

Here's a workaround that any man can employ to make sure they don't get shafted this way: DNA paternity test BEFORE your name goes down on the birth certificate. Men, demand it no matter what. Then you won't ever find yourself in this situation.

None of this eyeballing it nonsense (it looks/doesn't look like him/me). There is no excuse not to do a simple swab of a baby's cheek (and then your own), if it'll give an unbiased, definitive answer.

And nobody cares about the poor innocent kid who is caught up in this. Legitimacy is a given when a child is born in wedlock, for the benefit of the child.

Any man who spent his life raising and nuturing a child, and then decides he doesn't love the kid anymore because of a DNA test aren't fit to be fathers, and don't deserve the honor.

Why do people always want to run to the government to intervene in their personal lives. Get the CIA out of our bedrooms please.

biological father should have to pay its his fault, his dna and his genetic line passes on. So Pay up.
duped "father" should be paid compensation for time and money wasted as the child is of no biological use to him which is the reason we reproduce after all. Not to bring up some other guys genetic waste
