I believe people do it all the time. I don't know the actual legalities except of course you can't do it at the venue or it's considered scalping. I think you're safe if you start the bidding at or below face value then if people bid upwards of that, how could you help that? eBay may have a selling guide specifically regarding that...

Just lookup some tickets on Ebay that are from California. Ebay puts a warning within the product description, if there's a law for that state.

In California, scalping of an “entertainment event” tickets is illegal unless the scalper as the written permission of the venue owner or operator.
