Assault and battery. The cousin should be punished.

A black eye can be a violation or a misdemeanor depending on the victim. If the victim is experiencing tremendous pain and is frightened of her safety then the misdemeanor charge is good. If the victim doesn't really care and is like "no big deal" then the lesser charge (violation) will prevail.
Criminal cases on minors get forwarded to a juvenile bureau who work closely with family courts to assure some sort of punishment is inflicted on the suspect minor. Usually a harassment charge will be noted in their record but will not be followed up (thus no penalty for the minor) unless the individual has a pattern or large amount of similar incidents.
The misdemeanor charge will almost always be persued and though the penalty may not be as that of an adult it can have an ever lasting effect on the minor to change his/her behavior. I'm in NY and in my district most minors who commit a misdemeanor, especially a violent one, will at least get some probation. Good luck.

She can be charged with assault or battery but being that she's a minor they may not punish her that much. But the thing with juvenile courts is they act in the interest in the child's development as opposed to punishing her for breaking the law and being a danger to society.

I won't claim this to be correct but this idea was given to me by a cop. A person had said some untruths about the cop & I. The cop said i I took the guy for a ride to the country & whipped his A$@, I could go to the PD & file a complaint for him hitting my fist with his face!!! I don't know if they would've let me out the door afterwards but it sounds to me like they follow up on the first complaint, not the most righteous!!!!!

First thing you do is, you call and report the assault to the police. In the process of investigating the incident, they'll tell you what can be done. The age of the assailant does NOT preclude calling the cops!!!!

And you didn't whip her ***? Anyone ever even thinks about hitting my mother, there would be major trouble.

That said, you should consider assault and battery. Depending on the circumstances, it may be aggravated assault and battery.
