I believe penile penetration makes the difference.

Molestation is everything except actual intercourse, if I'm not mistaken. Rape is when that final step is taken.

I believe it is penetration. Penetration is rape, if there is not penetration then it is not rape, and it can be considered penetration even if something other than a penis is used,


Molest is also a term used for minors, not typically used for adults, that is sexual assault.

Molest contains every other form of sexual conduct excluding rape.

molestation frequently involves behaviors such as inappropriate touching/fondling that do not involve penetration. Rape requires penetration.
