Recently we had a shooting death in a busy bar district. The shooter was cowardly firing from a moving vehicle into a crowd of innocent bystanders and I suppose his target.
Unfortunately the only person hit was a 21 year old innocent bystander and in the end he died.
What do you think of setting the penalty of drive by or random shooting to the equivalent of 1st degree murder? In reality, that's what you're either trying to commit, or going to commit.

That makes sense to me. The killer obviously planned the shooting, whether or not he planned the exact target.
And now with the specter of terrorism, it may be appropriate to add extra penalties for random killing.

The basic conditions for any crime is intent, opportunity, and action. These drive-by wussies ARE cowards, and they ARE murderers even if they dont hit their intended target. Premeditated murder is distinguished by the INTENTION to murder someone, and that intent is shown when these losers aim their cheesy bullet-launcher at a bunch of people and pull the trigger. Actually, most of these drive by bullet sprayers are pathetic shooters, they have never trained with their weapons, they have the brains of a sponge, and all they can do is yank on a trigger and throw a bunch of lead downrange. I wonder where the cops are when these drive-by shootings occurr? Probably harassing ligitimate law-abiding gun owners who are peacefully going about their business, like the Barney Fifes in that Virginia Tech fiasco.

Not being a legal scholar I would think that drive by shootings are already a murder 1. Now if they are not I would agree that they should be. The reckless disregard for life should be punished as strong as the law allows.

Senseless, cowardice act of violence!!! Its usually the innocent bystandards that are the victims!! Here in Florida, last night on the news, a 9yr. old boy became a victim of a drive by. He was on his way home & was gunned down & killed during a drive by intended on someone else...Just soo sad, as to what this world is coming to!!

I agree with you about this.

When innocent people are put in danger because someone was acting irresponsibly they should be put in jail for the longest time possible.

I think this should also be the case with drunk drivers.
