spouse wants to see the baby and knows that she can be taken by them at any time because no papers have been filed for anything and has threatened to take her from me if she gets the chance before

Get something in writing, ANYTHING, both of you sign it, and it will be held up in court before anything formal is done. It can take up to and over a year to finalize a divorce with children. If you verbally make changes to written agreements, make sure you WRITE it down. Have a witness, someone willing to go to court with you to back up your story. COVER YOUR A$$!!!

Not enough information, but here is my advice.

Neither of you should use the child to get back at the other. You BOTH need to be mature enough to do what is best for the Baby, and put your own selfish, hurt feelings away when dealing with the kids.

Even though you two could not get along, realize that until the baby turns 18, in order to raise a good baby, you are going to still have to work together to raise her.

Since she has threatened to take the child and run already, I would not let her have visits that aren't supervised in some way untill papers have been filed and its been decided who would be the best custodian of the child.

Honestly, I would decide to let your spouse see her, and make there are a few freinds or family around just incase she gets out of control.

well you can see it in 2 different ways that yes the baby does have 2 parents and both parents deserve to see and be around the baby.
but if she has threaten to take her and runaway with her and not ever let you see her then yes i do see your point of view of on the situation
if she wants to see the baby then I say meet her in a public and stay with her the whole time.
I reallydont know what to tell you because I have never been in that situation before but if you want your baby that bad and no papers have been filed be the first on to file them before she does.

First of all, I don't think any mother unless impaired mentally or by drugs would have left you without taking her baby. I believe you confiscated the child back and now don't want to return her. Are you afraid you might have to pay child support? If there is something wrong with the mother, get to an attorney now, if not, let the poor woman be with her baby.
You have no legal right to prevent this.

You think papers matter? What about the child? If you are afraid of them running off with the child, then meet at a mutual place, such as a coffee shop and allow them time with the baby.

Sorry you're going through that. I hate when parents use their children like that. You have a legal right to see your child, with or without papers. If she's threatening to take her away (which she cannot do without going ot court to prove that you're an unfit father), I'd get a lawyer in a hurry. Good luck and God bless.

Legally, you have to let her see her child until a Judge orders otherwise. To not allow her to see the child will only hurt you in court later. Unfortunately, as she is the mother, she can "take" the child anytime she wants. But then again, as the father, you can do the same. I recommend getting paperwork filed asap, whether divorce paperwork or temporary custody paperwork.

You should never keep a child from either parent. That is not doing what is in the childs best interest.

I do not know the circumstances of your situation of why you have the child and not it's mother. But a Mother needs to have time with her child.
