How long does it take to get served papers after filing for divorce? My husband told me he filed for divorce 2 weeks ago and I still haven't gotten papers. Then he told my boss that he was just thinking about it. Was he telling me the truth when he said he filed already? Should I have already gotten served if he did?

It depends on the process server. Most of the time, the local sheriff's office is the process server and it may take 2-4 weeks before they serve you.
However, the court records are public and you can go to your local family court (or district court, superior court, whatever it's called there) to see if a case file has been established. At this point, you'd find a complaint for divorce and his affidavit for divorce, and a summons for you.

Papers are usually served immediately after filing with the court.. However, they are not required to be. Simply put, filing means he has registered the action with the court and had his petition stamped by the court recorder. There is a time limit which starts at this point, which varies from place to place. When I got divorced, this time limit was 90 days to serve notice and then she had 90 days after being served to respond to the notice before the petition was placed on the docket for a court date.

I think it took almost 3 1/2 weeks for my ex-husband to get served. It depends on how fast the court and/or process server is. However, if he hasn't filed then I can't answer your question. You can call the court in your area and see if he has filed for divorce.

He is probably full of crap!! There are a couple of ways to check this out. Go to the superior court website in your city where if the divorce has been filed is then public record. It will have an "atlas" number assigned to it, and they are simply waiting for verification of address and getting it to the process server. Second, ask him!! Divorce papers give the option to the petitioner to serve the papers himself, if you are still on speaking terms, then HE could have served the papers to you. You need to ask him what is going on, and check the information out for yourself. Good Luck!

I filed for a divorce with my (now) ex husband and it took every bit of 45 days for him to actually get served the papers.

It all depends on the state you live-in and how fast or slow the courts are moving...normally any it takes any where between 30 to 45 days for him to get the papers back and then he has 60 days to have them served on you

Typically, I would say under a week. I took my wife with me and I signed the papers right on the spot, but she refused. If his rep doesn't prioritize, the papers can sit there for a very long time. Does he procrastinate a lot? If so, he hasn't filed yet.

Your husbands' attorney has to have the sheriff serve you the divorce papers within 63 days after your husband has filed.

Once they are filed his attorney will have a process server or the sheriffs department come to you personally to serve you. How long this takes depends on how fast the attorney does his job and how quick your process server can locate you.
