My girlfriend and I got a little physical during an argument and the police was called out. My girlfriend and I were both arrested and charged w/misdemeanor domestic/assault and battery to a family member because we both assaulted one another. This is uncommon because usually in most cases only one person is arrested in a domestic situation which would be the perpetrator. The police said that we are both victims and both defendants. My GF & I have not been in trouble with the law, we laughed it off and made up after we bonded out on an unsecured/recoginance bond later that day. My Girlfriend and I want the get the charges dropped because we are going to counseling & we have made up. I called the District Attorneys office and told them we want to resolve this matter and drop the charges against each other. They said it’s a strong possibility but we needed to talk city prosecutor What are the chances of having to go to us jail time cause of a family fight? We have never been in trouble

You are a fool if you don't get a lawyer.

The D.A. can pursue charges against both of you without your willingness to pursue charges and could file for restraining orders against both of the to stay away from each other if they feel that your relationship is a toxic one and that the police may have to be called to intervene on any future altercations.

Both of you should get a lawyer to see if they can persuade the D.A. to drop the charges based on you both attending counseling without the Court having to intervene.
