juvenile went through the teen court and completed her punishment and know store wants to press charges.

juvenile completed her teen court duties, it was a 1st offense,the store contacted the police so how can she be charged twice?

You should go to the legal aid department if you can not afford a lawyer. Talk with someone who can inform you of your rights per your state guide lines.

The store requires compensation for the items that were stolen. They have a legitimate claim. A kid punches a hole in the wall and is punished. The hole is still there. Now the kid has to repair the hole. This is real life and there are consequences to choices made. You do damage to a person or company, then you must restore everything back to the way it was before you damaged it. Being put in the stocks and horse whipped is just the punishment. You still have to make good on the damage done.

Yes. The program is called 'civil restitution'. It has nothing to do with the original criminal charge and is a civil recourse to deter shoplifting that was enacted nationwide in 94. The state sets mandates which limit the amount of restitution required by the retailer. Most do in fact use the max and should have guidelines available upon request.

I should note that failure to pay the restitution can result in an additional criminal charge for theft of service.

She could be charged both criminally by the police/law enforcement (which you indicate has already occurred and punishment completed) and civilly by the store she stole items for to recover the value of the items that she took or attempted to take from the store, which does not sound like has been done.

But that doesn't prevent the store from pressing a civil suit, seeking damages and a court order that the offender never come back.

If they get the court order and the thief comes back... the thief gets to go to jail and stay there a while.
