A colleague was given a severance package after 3 months of work due to reporting ethical violations--the company called it a bad fit. The corp attorney sent a severance letter with several weeks pay and it was signed. But, my colleague was looking through her former desk files/stuff and found an offer letter that had her annual salary on it, and it was signed by her management. She got the offer letter before she signed her employment agreement. Since she already accepted the severance, can she now go back and push the salary on the offer letter--which is an implied contract?

No, as the offer letter was for annual salary based on being their for a year; as they chose to terminate her prior to a year and gave her severance, she has no recourse.

Check with an attorney...at least do this if we assume there is no validity to the "ethical violations".
