so my girlfriends mom was in a wreck.. pretty dumb. somehow her mom is having to use the vacation money to fix the car. i would appreciate if you guys could give me some oppinions or help from experience or something. here is what she said to me about the accident.

vacation is probably cancelled.
my mom got in a wreck today.
some other lady's fault in her
work parking lot. the police said
they don't come to private
property to file accident
reports
so basically that means we
have to pay for the wreck
repairs [hence vacation money]

so if you guys have questions more about the accident i will ask. PLEASE help.

Just because the police don't show up on private property doesn't mean that someone's not liable. I backed into a brand new car that a friend had just bought in his driveway. No police were called and obviously I was at fault (no one was in their car). That didn't stop me from filing insurance to get their car fixed.

In your case, both drivers need to contact their insurance agents and inform them of the wreck. Any witnesses or statements that have been made will be helpful. If it can't be agreed who's fault it is, your mom would probably have to sue the other driver or the other insurance company to collect.

Perhaps she doesn't want to chance the fact that she may have been partially at fault. Or, maybe she would rather spend the vacation money to fix the car rather than have her insurance jacked up for at least 3 years.

Because it was on private property, police officers do not file an accident report, you have to file it on a "blue form", which the police officer should have provided. If they did not, go to your local police station and request one. Even though it was on private property, you can claim it on your insurance. If it was the other persons fault, you can claim it on their insurance carrier. The insurance company will want a copy of the blue form so when you finish completing it, make copies of it for your record.

Her insurance should take care of it, she'd have to pay the deductible of course. And they will determine who is at fault as well. I mean if they both have insurance. Both Insurance company's will have to fight it out and it will be in arbitration until they can come up with the solution.

Shes right. They won't file on accidents in parking lots, so your responsible to fix your own car.
