Ok, you said, "and he rapes you...is it rape?" If someone makes you have sex with them against your will, it is rape, no matter the age. And you can press charges. If you are talking about consensual sex, then yes, you are both illegal. Both could be charged with statutory rape. Usually a parent of one party will come forward to press charges. However, when both parties are minors, within certain parameters, authorities are usually hesitant and often unwilling to pursue punishment of one party. Again, if you are talking about someone forcing you to have sex against your will or coercing you to have sex, then it is illegal and it is RAPE no matter how old either of you are, and you should immediately contact authorities. You can press charges.

Both previous answers are good. It also depends on which country you are living in, and in some cases which state of that country. In Australia, if both people are under 16 (the age of consent) and have consensual sex it is not rape or illegal.
If you were forced to have sex, no matter what the age of the victim or perpetrator, it is rape. It is also rape if one person over 16 has sex with a person under 16 -- that is called 'statuary rape', or 'technical rape'.

Rape is rape no matter the age. You should talk to someone who you feel comfortable with- parent counselor, mentor, teacher, even a cop if you feel comfortable about it. the sooner you file your complaint the better your outcome is likely to be. It is not your fault nor should you let anyone convince you that it is. Please seek counseling by a qualified person or even a survivor group to deal with your feelings. This seems to be the hardest thing to deal with and should be dealt with in order to keep from turning your feelings inward and letting them build.
