My landlord gave me written permission to obtain a business license in her home for the purpose of daycare. When I applied to HOA said no, so I continued and babysat a few kids and didn't get a license (by utah law I can have 4 kids w/o a license) my lease is ending soon and the HOA is trying to sue me if I don't stop babysitting kids. I want out of my lease 30 days early to move where I can do this. I was never given a copy of CR&R from the landlord, Can I get out of my lease because of this?

Wait a minute - the HOA said you couldn't do family daycare? That's illegal!

Get a copy of the Fair Housing Act - this is a FEDERAL LAW. An association cannot prevent you from doing family daycare, no matter what state you live in and no matter what your governing documents say. They may be able to make certain restrictions, but they cannot make you stop!

Send a copy to the Board with a letter. If they do not allow you, you should get an attorney.

You NEED to talk with a lawyer, not us.

A lawyer in Utah will know the laws, and I can't believe ANY state would let someone and over the age of 16be a babysitter without a license .

Stick out the 30 days. I am discusted that a state would not protect their children better then that. I thought Utah was child friendly, I guess I was wrong about that!

I doubt that you can get out of it. Your best bet is to move and let the landlord keep your deposit for the last months rent.

Talk to your landlord. If you have a reasonable relationship with her, she may be understanding enough to let you out of your contract. Otherwise, you are bound by that contract.

Not likely - but if your lease is ending soon, as you say, that shouldn't be a problem.
