Of course, because it hit the ground first does not negate
the pitch. Just as much as a if the batter swings at the pitch
and misses that it would be a a strike. I believe the only
other condition is that the batter makes a legitmate attempt to avoid the pitch. That will be determine by the umpire.

As long as he tries to get out of the way. You can't stay in the batters box and not move if a ball is coming at you. I think this happened in an actual game a few years ago and the ump did not award first base to the batter because he made no attempt to get out of the way.

yes, it's a hit batsman unless the batter swung at the pitch, then it would be a strike. Also, I'm assuming the batter tries to avoid being hit by the pitch, in which case it would be a ball.

If the batter made an attempt to get out of the way of the pitch it is considered HBP (hit by Pitch) and he is awarded 1st base.

Please read the archives before asking questions, as this situation has been addressed a zillion times.
As long as the pitch wasn't swung at and missed, and as long as the batter tried to avoid being hit, he is to be awarded first base. The ball is dead regardless of whether he is awarded first or not.
