What is a probate and how is that different from an open succession. I had a brother who died in an accident recently while riding in a car with a freind. The driver's insurance company want us (the family) to do a probate so that they can award us "X" amount of dollars. What is a probate? Please speak in layman's terms.

It is the method of deciding who is entitled to the estate (money) of the deceased and who is the executor (sorts out the estate). They need you to go through probabte so that they pay the money to the correct person. They don't want someone coming along in a year and claiming they should have been paid instead.
