she didn pay the medical bills is that fraud?

she had medical insurance and allstate paid for what was not paid through her medical insurance.she was suppose to pay jonhs hopkins with the money from allstae ans lied and told allstate she put it on her credit card and did not.

Assuming she is the legal guardian as a parent, it's not fraud, but your friend is responsible for any bills incurred because of the accident. If she didn't submit all the bills and expenses, that is her fault. Anyone she owes could file for collection. She can also negotiate the amount of money she owes with the provider. At best she's a lousy mom, and has shown people she know that she is not to be trusted.

Hi:

Unfortunately I believe that it is not fraud, but I could be wrong. Allstate is paying her for her auto insurance claim. Again, I could be wrong because laws differ from state to state.

I was in a sever auto accident and what happened is the auto insurance paid for the accident and my health insurance paid for my medical bills. This was 20 years ago and I am not sure but I think the laws here have changed where you can only claim one insurance.

I would call Allstate, you don't have to give them any information about your question, you just simply ask your question. You will then get the real legal answer you are searching for straight from Allstate's mouth.

Probably not. If there was no lawsuit, the insurance company paid her for her covered losses. If she doesn't pay them, she still owes the money, but the insurance did their part when they paid her.

What would probably happen next is the providers sue her AND Allstate, Allstate spends money on lawyers to claim that they paid under their contract and get out of the lawsuit, but they're probably going to be irritated enough to cancel her insurance.

It's not fraud, it's just irresponsible and stupid.

Yes. I work for a Chiropractor and handle personal injury/work comp cases. We had a patient do the same thing and when she didn't pay her bill with her settlement check, we sent her butt to collections. That is fraud and there should be penalties for such cases. What a joke!

Absolutely it is fraud, unless it was a settlement. This is exactly why some insurance companies do a joint check between patient and medical office.

Depends. If they gave her the money as a settlement, it was her right to do with it as she pleased. If it was ear-marked specifically for bill payment, then yes.
