i bought a item from a seller online and paid him full and it was ship and now the company ship it want it?

someone online sell to me a N93i for 400 egold i verify 1st the seller by phone he said everything is ok and he shown me some of his website and ebay account and i was to pay him 1/2 of the price and then he will shipped the item after i receive it i will then make the payment full after 1 week i recieve a call from a mobile number that i will receive a mobile phone and when i receive it was a N70 and now the after that he called me back with a no number on my cellphone ask for the full payment since the unit is a N70 i paid him 300usd egold and then after that night someone called me and asking to shipped back the cellphone bacause it was a fraud item and they accuse me to persecuted if i didnt send it back i explain to them what happen and gave them all the information on that someone who sold me the cellphone?my question em i accuse when i bought a item i never know that was a fraud and what can i do cause pretty sure if i return the item ill be the one ripped?

and when i check there website base on there terms and agreement there no such agreement for terms of acceptance and also when you purchase they you dont have to click on some thing to agree on there terms and condition and they are using paypal as there billing service and option to ask customer if you would like the online shop to call you or not and thats make me think why this seller uses this online shop to fraud...im currently in the philippines and i find out that the seller was form vietname and the online shop is a philippines gift shop own by a american person..what should i do is its the online store fault who shipped it because they are being careless and the order was place sameday shipping i dont think they had verify the customer yet and now im the one being sued for this and accused what can i do because right now that online only want to get there items back..but how about the money i spend and they should be after the person who buy the item right should i be involve

so what will i do return the mobile back or keep it ?

I don't think you obtained anything fraudulantly...and if you have already paid for the item (its not your fault you recieved the wrong item) its too bad for them, wait and see what happens, if there are charges brought against you please cooperate with them as far as information etc etc...tell them you will send the phone back when your money is refunded....

When soemone says "I'll ship this to you for half up front " this should set the bells and whistles in your mind to blazing. Check the guys feedback on Ebay carefully and see if he's got a lot of fake feedback (low numbered buyers means lots of fake accounts he set up just to leave himself feedback.)

The fact that y ou send Euro Dollars (e-gold?) I would contact a lawyer in your area and ask for the actual liability you may be in after receiving a stolen item -IF in fact hte item is really stolen.
