When I was in second grade, a friend of mine was THROWN off the top of the jungle gym and landed face first. No teacher was present. It took a person who lived across the street from the school calling an ambulance to get anyone to come out.
He ended up needing reconstructive surgery on his face and was left a bit brain damaged. It wasn't until his family sued that they changed ANYTHING. (And then they took away the jungle gym, the idiots, but at least they put a teacher outside.)
Today, it's your kid needing 14 stitches because no teacher was present. Tomorrow, it's someone else's kid getting brain damage because no teacher was present. And if nobody sues, nothing changes.

You can always file suit. Consult an attorney. They will be in an excellent position to tell you if you have a good case against the school or anyone else. An attorney may also elect to sue private companies that may have installed or maintianed equipment on the playground or the manufacturer of said equipment or anyone else who may have been involved who wasn't acting as an agent of the school.
Personal injury attorneys will normally consult with you free of charge to determine if your case is worth persuing. If they elect to represent you, their fee will likely be contingent on a monetary judgment or settlement, so you won't have to pay any fees unless they are able to collect damages. Then their fee will be deducted from the amout you are awarded (normally 30-40%).

You say it was an accident and there could be any number of reasons there wasn't a teacher around. All that suing the school will do is take more money out of a school system which is already short of funds - ultimately you’ll be depriving your own and other children of good schooling and no-one wants that.

Yes,Your kid and others will pay for. I am sure the lawyer will be glad to help. What are you going to accomplish this suing stuff? I urge you to contact the school principal and then school district demand them to foot all your kid medical bills.Meanwhile,demand the school to have more teachers at the playground.Then recruit more parents participate in the playground activities. Kids get hurt, and how do you know no one was around! How old is your kid? If the child was 4 or 5 you might have a major issue. That is neglect!
And why would you want to sue for that. Why don't you bring the issue up to the principle and let it wind it's course. You may actually help someone else!
Besides, you aren't going to get any money!

what was he doing? normal play that would have been overlooked by a teacher...and there for no teacher being present has zero effect...or was he standing on top the monkey bars and behaving in a way that a teacher being present would have changed the out come...i know you are upset, but public schools have it financially bad enough....first take into account the entire situation (as objectively as you can considering your child is hurt)...then get actual legal counsel after that.

the answer is yes you can, but no you shouldnt. we baby kids too much. stiches is part of being a kid. we keep suing everyone and it just hurts our economy. like teachers dont already get crappy pay and the schools arent lacking enough in supplies... do we really need to take more money from them.
