Lovitall was mostly correct. Except that there are not enough facts on which to offer a valid answer. The main question that has to be answered is how long ago did mom die and was probate opened when she did pass away?

No, this is paid to the child with mom serving as custodian of the support money. The law will catch up with him and then he will have plenty of time to think about it. She can either let the local child support collection agency know of his whereabouts or sue him for money owed in small claims court

If he owes he owes there's no getting around it . The money would go to the daughter just as the house or anything ells she owns unless it was put in a will to give it to another person . After 5000 they put them in jail if he doesn't pay in Michigan

how old is she?

In Michigan, there's a time limit, a statute of limitations, for collecting child support. Check the michigan friend of the court website, they have a lot of good info. Good luck!
