If he wants joint custody and wants more time with his children, then of course he should take her back to court and ask for joint custody.

In response to Sweet Belly "Can a father go back to court for full custody"?
The answer is yes and no. It depends entirely on the state in which the original order was issued and the 'significant change in circumstances' that have occurred since the initial order was issued. If nothing else, he can most likely file for a change in custody to shared legal and residential custody but and it's a very big but, if there was a reason the court ordered full custody to the mother, it's very likely that the reason will be part of the court's decision on the new motion so it had better be resolved.

Also, any issue of a divorce except the property settlement and, in some cases, alimony, can be revisited through petition.

Child custody and child support are the two areas you can go back to court on after the final divorce decree. If you feel that you have a strong case that is definitely in the best interest of the kids then by all means, go for it. Just petition the court for a remodification hearing onchild custody for this to happen

Absolutely, if you're doing it for the right intentions. The child needs both parents, and as long as you and hubby aren't doing it to cut back on child support payments, go for it! Sorry if that's insulting, but it's so common and my hubby and I have had to bypass that rumor while he's going for more custody...Good Luck!
