My exwife dropped my son off this morning for my extended visitation for the summer. I am currently unemployed at this moment and searching for a job. My son was diagnosed with juvenile diabetes earlier this year. He is on several medications including insulin. The medications run around $400 a month. Since I lost my job my son lost his medical coverage. So my ex wife has been paying for the medication until another insurance kicks in. Well when she dropped our son off she dropped off 5 prescriptions even a prescription for the machine to test his blood sugar. Being unemployed I do not have the $500 to go & purchase his needed supplies. My current wife contact my ex wife & asked if we could come and get the medication. She told her no that it was our problem & we needed to get the medication or she would come get our son. She told my wife that if we pay the fifty percent of her past medical expenses then she would consider sending the medication. Is this right? Can she legally do this

I have contacted the police and they tell me its a civil matter and they can not force her to give me the meds to go to the pharmacy and get the meds.

Well, looks like it is time to buck up and take care of your son. Just because you aren't working that doesn't mean that your son doesn't need things like food, clothes, medicene, etc. Why should his mother have to pay all of the expenses?? I bet you don't pay child support either, huh? You knew he was coming for a visit. Looks like you should have gone to McDonald's and gained employment so you could take care of your son. I don't blame her one bit and I too would come get him if you can't find the monry to pay for his medical needs.

Sounds like mom is pretty sore. Even putting her child's needs at the end of priorities list. That does not sound right that she cannot be forced to bring you the meds. Have you contacted your attorney? I would still call around to see if there is anything you can do. Also if you have partial custody and she is taking care of the medical stuff right now then she is responsible for making sure he has his meds. I would think she can get in trouble for that. Now if you are laid off then I would contact Social services and see about free medical for your child since he has diabetes and see if you can get temporary assistance. Good Luck

I think your ex needs to grow up. This is your child's life she's putting in danger. If she has the money why would she not want to buy his meds. Try coming to an agreement with her, pay her later when you do have a job.
I'd like to add that you have a wife who should be more than willing to help out! I assume she does have a job. And you need to get out there and find a job instead of being online.

there's a big issue here. the issue is that she is spending a lot of money on medication for your son which you need to be helping with, no doubt. jobless: find a job BUT
IT IS NOT RIGHT FOR HER TO BRING THIS UP NOW AND USE THIS POOR CHILD AS SOME KIND OF TOOL TO GET WHAT SHE WANTS. YOU SHOULD CALL CHILD PROTECTIVE SERVICES ON HER AND DO IT NOW!
YOU SHOULD GO FILE AT THE LOCAL SRS OFFICE AND GET FOOD STAMPS WHILE THE CHILD IS IN YOUR CUSTODY FOR THE SUMMER AND GET THE CHILD ON INSURANCE THROUGH THE STATE OF COURSE LETTING THEM KNOW HOW DESPERATE YOU ARE IN NEED FOR THE DIABETIC MEDICINE. I DON'T KNOW HOW BAD OF A DIABETIC YOUR CHILD IS, BUT IT COULD BE LIFE THREATENING IF THE BLOOD SUGAR GETS TOO HIGH OR TOO LOW. GO TODAY ! YOUR EX WIFE IS WRONG.!***THE MOST IMPORTANT THING HERE CONCERNING YOUR CHILDS DIABETES, IS THAT YOU KNOW WHAT THE BLOOD SUGAR IS. I KNOW THE COUNTY HEALTH DEPT. WILL CHECK BLOOD SUGARS FOR YOU AND CAN ALSO HELP YOU WITH GETTING STATE INSURANCE. HIGH BLOOD SUGAR LEFT UNTREATED DAMAGES ORGANS LIKE KIDNEYS, AND CLOGS ARTERIES AMONG A HOST OF OTHER THINGS.

you had the child.
you are remarried. have your wife pay for some of the meds.
you are responsible to provide for your child while he is with you. did you expect your x to pay for his food and buy his movie tickets too???
what makes you think that you are off the hook because you don't have a job!!!
why should your x pay for his meds or anything else while the the child is with you for the summer.
pony up papa, dig some dollars out of your pocket and quit trying to dig dollars out of the pocket of your x!!!
go to social services and ask for a medical card.
call the American diabetes assn. they will give you a meter for free.
quit cry-babying and get your child what he needs. quit expecting others to pay for the things you need to have!!!

Contact the district attorney and ask that a charge of Child Endangerment be brought against her. Then find a job. the family court isn't going to think too kindly of either of you for playing with your son's life like this.

Legally no and by doing so it putting this boy in a possible life and death situation. You need the help of the local authorities in this and let her worry about obtaining repay later. The police dept should be able to get the medicine from her so call them before its too late. Its understandable whats she is oing but is totally illegal to put his life in danger

If your divorce decree states that you have to maintain medical coverage on your child techinically she could sue you for the amount that she has already paid. So if it is in the decree then yes legally she could do that.

you have to love your child more than you hate your ex
if the meds are out of pocket expense for her, then it is for you also
ask yourself,,, what is BEST for the child?
