the one thats not infected has no fish in because it is new shall is their any chance that the fungus has spread and the new fish will catch it when i put them in

That depends on which "fungus" you have. Saprolegnia and Achyla are present in most tanks, so if it's that, it's already in your new tank. This rarely attacks healthy fish, but will infect those that have wounds, are stressed by poor water quality or parasites, or are already dead. You can easily find out if this is in a tank by getting a container of the tank water and adding a sesame seed or shrimp pellet. It it's in the water, your item will be fuzzy in two days. Your fish could also have Columnaris. This is a bacteria that looks similar to the Saprolegnia, but the strands aren't usually as long and in Columnaris, and the edge is circular where in Saprolegnia it's more irregular. This may be something you could introduce to the other tank if this is what your fish have.

NOTE: As long as you have water on your hands (or net, or other tank equipment) there's always a possibility that anything from one tank can be introduced to another. A good rinse with hot water between tanks will go a long way in preventing the spread of disease and parasites.

possible. it is even possible even if you hadnt [ut your hand in both tanks. the farther apart the less likely.
