I was told by my former employer that all drivers who are now employed by them are to go as independent contractors. After reviewing what they are offering me as pay it isn't to my advantage with the price of gas. I was also told I would have a set schedule and another driver told me they thought as an independent contractor the company could'nt do that?

Employer have little control over independent contractor. Employer can tell you when they want the job to be done, but they cannot tell you when you supposed to start working and when you supposed to end your shift. You, as an employee, have completely control over the job. You choose when to start working as long as you can deliver it before the deadline. If you feel that your employer have too much control over you, you need to speak out. Some employer like to consider you as their independent contractor, but in fact you are their ordinary employee. The reason behind it because hiring independent contractor is cheaper than ordinary employee. I don't know what kind of driver are you, but I was told that truck drivers who drive company trucks are usually ordinary employees.

Sure the company can set your schedule.
The only thing they don't have to do is pay benefits, Unemployment tax and worker's comp premiums because you are a self-employed contractor and you are responsible for these yourself.

If you work for them you have two choices, their rules or work some place else!
