We know she is a prescription meds abuser, with a long track record in all hospitals within a three hour radius. She has had to move from towns brfore because of her and her mothers abuse of prescription meds. She has my husbands almost 18 month old son and it is not a good situation. We know she is using drugs again, maybe even cocaine. She begs his parents for money and even for meds. We are tired of knowing his son is unhealthy and neglected and paying child support is a joke because it just goes up her nose. My husband is afraid to call Children's Services and her end up running. We haven't seen the baby in over four months because she won't comply to visitation. We are just tired of seeing the baby dirty and in crappy old clothes and being left with her pill head mother for days at a time while she parties. She even drives with him while drugged up. Has anyone else ever dealt with this and have any idea of what Children's Services will do? We just don't want her to run.

First hire a lawyer to get custody of that child. No child should have to live with someone who is a drug addict. It is his place to take care of his child and if he knows she is this way, then stop worrying about what the State will do and act upon your own before this child gets hurt. The baby should be the first thing he settles before anything else. While the child is with her Mother take the police over to get his child, he does have a court order for visitation, so they will take the child and allow him to see the baby. Take your court order and have it ready to show them.

You need to start documenting all that you have seen. From being dirty to being underfed. You can ask for a doctor to exam the baby and determine if the child can be classified as "Failing to Thrive". If so... than you take all that to CPS and you file your report. They can roll out and take the baby away from the ex for 24 to 36 hours. At that point she will have to go before a judge and defend herself against these charges. The baby should be sent to your bf, provided he has a clean record and there is no real reason why you guys can't have custody.

Move quickly, for the sake of the child. Give no warning to her, just do it.

Children's services will take the baby out of the situation and give the baby to the father if he is wanting the baby. Have your husband call childrens services, tell them what is going on and that he wants the baby. If you get visitation again(which she is supposed to compy to because of court ordered papers) keep the baby. Have you thought about calling the police the next time you try to have visitation and she won't let you have the baby?

Call the police Now..DONT WAIT. It IS endagering the childs welfar that that is a crime...OR worse the child might be found dead. Child services will get invalved then too....They will make sure that your husband has the baby all the time, She will have superviced visitation , court will order drug testting to make sure she is clean around the baby. Hubby will get 100% custoty and she will have to pay child support.

child services would start an investigation. she could run...investigations take forever....i am currently going through one to get my son back. (i am a young mom and told child services when my 18 month old was born that i wasn't ready.) the child would then be taken from the mother and probably given to you and his father. if the child is looking real bad he will be removed promptly. dirty, malnurished, and ratty clothes don't cut it. she, by your discription is an unfit mother and the baby doesn't deserve that treatment. good luck i know you will have that child soon if you report...she obviously doesn't care about her child. you can also go through the courts for custody but that takes even longer. plus child services likes to keep children with family members.

I work with family's .... so I know CPS if get wind they WILL take the child or children to a protective place if be a relative or foster home,,,,,, if you are related maybe you should try and get temp.custody so that the baby doesnt get into the system...and keep the child until the mother has been through a program..... and only then do you give her another chance...

You shouldn't care what they will do, you should only care to get the child out of that situation. Call and let the chips fall where they may.

Keep in mind that you "knowing" she is on drugs is different than childrens services finding out.

i dont understand why he doesnt sue for custody, if it can be proven that she is a danger they will charge her with abuse or neglect and he will win. Get a lawyer and sue her, you could probably even win on the visitation thing, or at least get her in trouble for contempt. Then again, the courts arent very helpful, and she probably wants the child support and welfare to pay for her habit so she might fight it.

Tell them this is an emergency and they need to go there with the police together, the baby needs to be removed from there today. Tell s.s the child is in immediate danger. Sooner or later he will get hurt, already we know he is missing meals and other essentials. That child is suffering.

My suggestion would be to call DYFS. As the father of the child he has an obligation to the child's well being. He can call and speak to an advocate before anything is done. He would get custody as next of kin. So what are you waiting for.
