I know how you feel, my ex owes me $26,000 in child support and is in jail for it. I don't know what state you live in, but in Virginia, the only way for an ex to give up parental rights is if you are remarried and your spouse is willing to adopt. Va feels 2 parents need to be financially responsible for a child. (Even though your spouse obviously isn't). As for jail time for failure to pay support, I have had a hard time because I receive no state benefits. Unfortunately, they seem to really go after the deadbeat parents if the custodial parent gets any assistance. My advice is, if you aren't already, turn your case over to the child support enforcement if your state offers one, and every 30 days you don't receive a payment, file a show cause in your local court. Eventually they will get tired of seeing you and put him jail! Good luck!

First of all, The United States has abolished debtors prisons so he can go 20 years without paying child support and not go to jail for that reason.
What the state CAN DO however, is swear out a felony warrant for failure to pay and if he doesn't then pay the arrears send him to jail on the criminal charge.
Secondly, you never said whether or not you have a visitation order. if you do, then you are in contempt of court for not taking the child to visit. In effect, you are breaking the law because he is. Courts take a very dim view of this practice because custody, support and visitation are all separate issues.
As to getting him to sign over his rights, the only way to give you an answer on this would be to know in what state your custody order was issued. The Majority of states will not allow a Termination proceeding without an attendant adoption in place. So, unless you have someone ready to adopt the child, your chances of initiating a TPR action are slim.

I really think you need to call an attorney and set up a consultation. It won't be too expensive, and he/she can answer all of your questions. You would have to get an attorney to send him to jail over child suppport anyway, so you might as well go now. Good luck.

I would normally say it's his child too and revoking his rights is wrong. But in your case get a lawyer and let him talk to your ex , he would probably get farther with him then you would. This man is so low he probably wouldn't have any problem signing off on his child.

when he gets 2000 dollars behind you can sue to have him jailed... they dont deny rights from on payment they deny rights for no contact.. if he goes voluntarily without contacting you rkid for one year, you can strip him of his rights....
if you remarry, you can suggest he allow your new husband to adopt... and he may go for it.
Id have him jailed a few times first then he will be more likely to sign rights over.
if he has only supervised visitaion and isnt inforcing his rights... he really doesnt have many left to strip him of... seek legal help... and then have him jailed when 2000 bucks behind.... fall in love get married have new husband adopt... end of rights of bio father.
